Islamabad High Court allows legal sheesha cafes

The latest order effectively draws a line between legitimate and illegitimate sheesha businesses

The Islamabad High Court (IHC) has clarified in its written order that “restaurants and establishments legally serving sheesha under valid permits issued by the competent authorities should not face coercive action, drawing a distinction between lawful businesses and those operating in violation of the law.”

The clarification comes days after the Islamabad administration announced a complete ban on the operation of sheesha cafés across the federal capital.

On September 9, Deputy Commissioner Islamabad announced that, following the directions of the Islamabad High Court, a complete ban had been imposed with immediate effect on the operation of sheesha cafés in Islamabad until further orders. The cafés were subsequently closed down.

In its latest written order, however, the IHC directed the relevant authorities to regulate sheesha establishments in accordance with the law. The court specifically clarified that “no coercive measures shall be adopted” against any establishment or restaurant that is carrying on its business lawfully and serving sheesha in accordance with permits duly issued by the competent authorities.

 

The IHC also directed the ICT Police and Anti-Narcotics Force (ANF)to continue taking necessary measures against illegal sheesha-related activities and narcotics-related offences, where there is material indicating unlawful involvement.

The court further stated that the competent authorities, while regulating such establishments, must remain mindful of their responsibility to protect public health and safeguard the younger generation from smoking, substance abuse and other unlawful practices.

It also made clear that where any illegal activity or violation of any law or permit is found at an establishment, “the law shall take its own course.”

The matter has been directed to be relisted on October 13, 2026.
